
Terms of Service for The Edge

Welcome to The Edge, a self-learning platform developed and operated by Ascend Now, Inc.
(“Ascend Now,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to
and use of The Edge, including all related websites, applications, services, content, and
features (collectively, the “Platform”).
By using The Edge, you (“you,” “your,” “User,” “Student,” “Educator,” “School,” or
“Administrator,” as applicable) agree to these Terms. If you do not agree, you may not use the
Platform.
1. Eligibility and Accounts
1.1 Age Requirements
• Users under the age of 18 must have consent from a parent, guardian, or authorized
school representative.
• Users under 13 (or the equivalent minimum age in their jurisdiction) may only access the
Platform through a school or educational institution in compliance with applicable child
data protection laws.
1.2 Account Creation
• To use The Edge, you must register for an account with accurate, current, and complete
information.
• Schools may create bulk accounts on behalf of students. Administrators are responsible
for ensuring proper permissions.
1.3 Account Security
• You are responsible for maintaining confidentiality of your login credentials.
• Ascend Now is not liable for unauthorized access resulting from lost or stolen credentials.
2. Educational Use and License
2.1 License Grant
Ascend Now grants you a limited, non-exclusive, non-transferable, revocable license to use The
Edge for educational purposes only.
2.2 Restrictions
• You may not copy, distribute, modify, reverse engineer, or resell any part of the Platform.
• You may not use The Edge for commercial tutoring, resale, or competitive analysis without
prior written consent.
2.3 Institutional Access
Schools are licensed on a subscription basis. Access is limited to the number of seats, users, or
terms specified in their purchase agreement.
3. Privacy and Data Protection
3.1 Student Data
Ascend Now is committed to protecting student data in accordance with applicable student data
privacy laws, including FERPA and COPPA, as well as other data protection regulations that
may apply based on user location or institutional requirements. Student data is processed solely
for educational purposes and is never sold to third parties.
3.2 Data Ownership
• Schools retain ownership of student records.
• Ascend Now acts as a data processor and uses data only to provide, improve, and secure
the Platform.
3.3 Parent and Student Rights
• Parents/guardians may request access, correction, or deletion of their child’s personal
data by contacting help@buildmyedge.com.
• Users have the right to opt out of certain data uses, subject to educational requirements.
3.4 Data Security
Ascend Now maintains industry-standard technical, organizational, and administrative
safeguards to protect the security and confidentiality of data processed through the Platform.
4. User Conduct
You agree not to:
• Upload, share, or transmit any unlawful, harmful, or offensive material.
• Harass, bully, or impersonate others.
• Interfere with Platform operations or security.
• Attempt to access accounts or data not belonging to you.
Violation may result in account suspension or termination.
5. Content and Intellectual Property
5.1 Ownership
• All Platform content, curriculum, software, logos, and trademarks are owned by Ascend
Now or its licensors.
5.2 User-Generated Content
• Students and educators may submit assignments, reflections, or uploads.
• By submitting, you grant Ascend Now a limited license to host, display, and use the
content solely for educational purposes.
5.3 Third-Party Content
• The Platform may include links or integrations with third-party tools. Ascend Now is not
responsible for external content or practices.
6. Payment and Subscriptions
6.1 Fees
Access to The Edge may be subject to subscription fees, payable under agreed terms with the
school or individual purchaser.
6.2 Renewals and Cancellations
• Unless otherwise stated, subscriptions automatically renew unless cancelled.
• Schools must provide written notice 30 days before renewal to terminate service.
6.3 Refunds
Refunds are issued only where required by law or explicitly agreed in writing.
7. Disclaimers and Limitations
7.1 Educational Disclaimer
The Edge is an educational support tool, not a substitute for accredited school instruction,
professional counseling, or therapy.
7.2 No Warranty
The Platform is provided “as is” and “as available.” We disclaim all warranties, express or
implied, including merchantability, fitness for purpose, and non-infringement.
7.3 Limitation of Liability
To the fullest extent permitted by law:
• Ascend Now shall not be liable for indirect, incidental, consequential, or punitive damages.
• Direct liability is capped at the total fees paid by the institution or user in the preceding 12
months.
8. Termination
• Ascend Now may suspend or terminate accounts that violate these Terms.
• Schools may terminate institutional agreements per the contract terms.
• Upon termination, users must cease using the Platform and delete any materials obtained
unlawfully.
9. Governing Law and Dispute Resolution
9.1 Governing Law
These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to
conflict-of-law principles.
9.2 Arbitration
Any dispute shall be resolved through binding arbitration under the American Arbitration
Association (AAA) rules. Class actions are not permitted.
9.3 Venue
Arbitration will occur in Wilmington, Delaware, unless otherwise agreed.
10. Changes to Terms
Ascend Now may update these Terms at any time. Updates will be posted with a revised
effective date. Continued use of the Platform constitutes acceptance of updated Terms.
